Appellant Jeffrey Snyder created a plastic replica of a well-known, public-domain cast-iron “Uncle Sam” mechanical bank. To facilitate mass production in plastic, Snyder’s version was smaller (nine inches vs. eleven) and incorporated several minor design changes. These included a smoother texture on the carpetbag, leaves instead of arrows in the eagle’s talons, and an umbrella molded as part of the main figure rather than as a separate piece. Snyder obtained a copyright registration for his plastic bank as a “work of art.” Appellee L. Batlin & Son, Inc., a competitor, began importing its own plastic and cast-iron versions of the bank. When U.S. Customs, enforcing Snyder’s copyright, seized Batlin’s imports, Batlin sued to have the copyright declared invalid.
