California and Nevada formed the Tahoe Regional Planning Agency (TRPA) via an interstate compact, approved by Congress, to regulate land use in the Lake Tahoe Basin. The compact designated TRPA as a “separate legal entity” and a “political subdivision.” Its governing board consisted mainly of appointees from local counties and cities, with only a minority appointed by the states. The compact stipulated that TRPA’s funding would come from the counties, not the states, and that its obligations were not binding on the states. Property owners sued TRPA and its individual board members under 42 U.S.C. § 1983, alleging that a land-use ordinance amounted to an unconstitutional taking of their property. The lower court held that TRPA was immune from suit under the Eleventh Amendment. The Supreme Court granted certiorari to determine TRPA’s Eleventh Amendment immunity and the personal immunity of its board members.
