Land Associates, Inc. initiated a foreclosure action on a land sales contract, initially seeking strict foreclosure but later amending to request a judicial sale. After the complaint was filed, but before judgment, two trust deeds and a judgment were recorded against the buyer (Becker), creating junior liens. These pendente lite lienholders were not joined in the foreclosure. The trial court entered a stipulated decree foreclosing all defendants’ interests, subject to statutory redemption. Land Associates purchased the property at the sheriff’s sale. Twenty-seven days later, Land Associates obtained an ex parte order for the sheriff to issue a deed, assigned its certificate of sale to E & B Investors, and conveyed the property. The sale was confirmed the next day. Subsequently, the three pendente lite lien creditors assigned their interests to Bautista. Fifty-seven days after the sale, Bautista attempted to redeem. The sheriff refused due to the issued deed. Bautista intervened, seeking to set aside the order authorizing the deed and to exercise her statutory redemption rights. The trial court dismissed her complaint, and the Court of Appeals affirmed.
