Janice Langbehn and her life partner, Lisa Pond, were in Miami with their adopted children when Pond suffered a brain aneurysm and was taken to Ryder Trauma Center, operated by the Public Health Trust. Langbehn immediately identified herself as Pond’s partner and provided a power of attorney designating her as Pond’s healthcare surrogate. For approximately eight hours, hospital staff, including a social worker who stated they were in an “anti-gay city and state,” denied Langbehn and her children visitation and refused to provide information about Pond’s condition. Despite this, doctors did consult with Langbehn to obtain consent for a brain monitor and to discuss the futility of surgery. Langbehn was permitted to be present for last rites but was otherwise denied access until Pond was transferred to the ICU, shortly before her death. Langbehn, her children, and Pond’s estate sued the hospital and its employees for negligence, intentional and negligent infliction of emotional distress (IIED/NIED), and breach of fiduciary duty.
