Plaintiff Michael LaPlace boarded his horse, Park Me In First, at Briere stable under a verbal agreement for care and training. On February 12, 2006, while LaPlace was away, Charlene Bridgwood, another boarder, lunged (exercised) the horse, allegedly without LaPlace’s authorization. Bridgwood claimed she was helping due to potential staff shortages and believed Gultz, overseeing the stable, permitted it; Gultz denied this. Bridgwood, an experienced horse handler, lunged her own horse first without incident. Five minutes into lunging Park Me In First, the horse reared, collapsed, bled from its nose, and died. A necropsy was not performed immediately; plaintiff later requested one, but it was too late. The cause of death remained unknown, with no evidence that the lunging, negligent or otherwise, caused the death. LaPlace sued Bridgwood for conversion and negligence, and Briere stable for breach of bailment, conversion, and negligence.
