Grendel’s Den, Inc., a restaurant in Cambridge, applied for a liquor license. Its premises were located ten feet from the Holy Cross Armenian Catholic Parish. The church filed a written objection to the application. Pursuant to § 16C, the Cambridge License Commission denied the application, stating that the church’s objection was the sole basis for its decision. The Massachusetts Supreme Judicial Court had previously interpreted the statute as conferring a “veto power” upon the specified institutions. Grendel’s Den filed suit in federal court, alleging that the statute, by granting a governmental power to a religious entity, was facially unconstitutional under the Establishment Clause of the First Amendment.
