Case Brief Summary & Legal Analysis

General Brief
3 min read

tl;dr: A state law giving churches an absolute veto over liquor license applications for nearby properties was struck down. The Court found this delegated a core governmental power to a religious entity, violating the First Amendment’s Establishment Clause.

Legal Significance: Delegating discretionary governmental power, such as licensing authority, to a religious institution constitutes a “fusion of governmental and religious functions” that violates the Establishment Clause, particularly the entanglement and primary effect prongs of the Lemon test.

Case Facts & Court Holding

Key Facts & Case Background

A Massachusetts statute, Mass. Gen. Laws ch. 138, § 16C, provided that premises located within 500 feet of a church or school could not be licensed for the sale of alcoholic beverages if the governing body of that church or school filed a written objection. Grendel’s Den, Inc., a restaurant in Cambridge, applied for a liquor license. Its premises were located ten feet from the Holy Cross Armenian Catholic Parish. The church filed a written objection to the application. Pursuant to § 16C, the Cambridge License Commission denied the application, stating that the church’s objection was the sole basis for its decision. The Massachusetts Supreme Judicial Court had previously interpreted the statute as conferring a “veto power” upon the specified institutions. Grendel’s Den filed suit in federal court, alleging that the statute, by granting a governmental power to a religious entity, was facially unconstitutional under the Establishment Clause of the First Amendment.
