Case Brief Summary & Legal Analysis
tl;dr: A sibling attempted to revoke the authority he had granted to his sister to sell jointly-owned property. The court held the revocation was effective because the sister’s agency was not an irrevocable ‘power coupled with an interest,’ as she had no proprietary stake in his specific share.
Legal Significance: This case clarifies the narrow definition of an irrevocable agency, holding that a ‘power coupled with an interest’ requires the agent to have a proprietary interest in the subject matter of the power itself, not merely an interest in the underlying property.

Case Facts & Court Holding
Key Facts & Case Background
Four siblings inherited a farm as tenants in common, each holding an undivided one-fourth interest. They entered into a recorded agreement appointing one sibling, Hannah, as their attorney-in-fact with the sole authority to sell the entire property. The agreement stipulated that upon Hannah’s death, her authority would pass to the next oldest sibling, Laura. The agreement was silent as to its duration or revocability. After Hannah’s death, Laura assumed the role of agent. A dispute arose, and one sibling, M.L. Dawson Lee, Jr. (the principal), notified Laura (the agent) that he was revoking her authority to act on his behalf. Despite this, Laura entered into a contract to sell the entire property to a third party, signing on behalf of all siblings. Dawson filed suit, seeking a declaratory judgment that he had effectively revoked Laura’s agency prior to the sale and that the contract was therefore invalid as to his interest. The trial court granted summary judgment for the defendants, holding the agency was irrevocable. Dawson appealed.
