Jonathan Lehr was the putative father of Jessica, a child born out of wedlock. For the first two years of Jessica’s life, Lehr did not live with the child or her mother, Lorraine Robertson, nor did he provide financial support or establish a substantial relationship with the child. Robertson later married Richard Robertson. When Jessica was over two years old, the Robertsons petitioned to adopt her. New York law provided several ways for a putative father to receive notice of an adoption, including by mailing a postcard to a “putative father registry.” Lehr did not register, nor did he meet any other statutory criteria for mandatory notice. One month after the adoption petition was filed, Lehr filed a separate paternity and visitation petition in another county. The adoption court was made aware of Lehr’s paternity action but proceeded to enter the final order of adoption without providing notice to Lehr. Lehr challenged the adoption, arguing that the lack of notice violated his Due Process and Equal Protection rights under the Fourteenth Amendment.
