Tammy Lemley, a minor, and Bobby Lee Nash, Sr., residents of Ohio, gave birth to Bobby Lee Nash, Jr. The parents, through Ohio attorneys, arranged for the child’s adoption by Gene and Anna Barr of West Virginia. Lemley signed initial consent papers in Ohio while a minor and additional papers in West Virginia after reaching majority, receiving $400. Lemley’s parents immediately sought the child’s return, alleging the consent was invalid. Ohio attorneys failed to disclose that Ohio law required judicial approval for a minor’s consent. An Ohio court subsequently found the placement illegal under Ohio Rev.Code Ann. 5103.16, Lemley’s consent invalid due to duress and lack of understanding, and ordered the attorneys to disclose the custodians’ (Barrs’) identity. The Barrs, aware of the Ohio proceedings, directed their attorneys to assert attorney-client privilege and initiated adoption proceedings in West Virginia. After Ohio appellate courts affirmed, the Barrs’ identity was revealed. Lemley then filed a habeas corpus action in West Virginia. The West Virginia trial court denied full faith and credit to the Ohio judgment and upheld the West Virginia adoption.
