Defendant Mary Jane Powers, a former student of Plaintiff Lewis Lester at Colby College, was upset by a classroom discussion on homosexuality that she perceived as hostile. During this time, Powers was privately struggling with her own sexual orientation. Years later, when Lester was under consideration for tenure, the college solicited comments from former students. At the invitation of the Dean of Faculty, Powers submitted a letter after the official deadline. The letter recounted her negative perception of the classroom discussion and other minor incidents, expressed her opinion that Lester was homophobic and intimidating, and concluded with a recommendation that he be denied tenure. The tenure committee initially voted against tenure, but upon reconsideration, reversed its decision and recommended tenure. The college president, however, independently reviewed Lester’s file and recommended against tenure, a decision the board of trustees adopted. Lester was denied tenure and subsequently sued Powers for libel based on her letter.
