Defendant Oahe Electric Cooperative (Coop) constructed a high-voltage transmission line across the plaintiffs’ (Lovells) farm. The line passed 27 feet above and slightly to the side of a pre-existing well. The Lovells, who were familiar with the well and the location of the power line, attempted to pull a long metal pipe from the well. They were aware of the general dangers of electricity and had seen public warnings from the Coop about keeping equipment away from power lines. Despite this knowledge, they did not contact the Coop to have the power shut off, a service the Coop would have provided. While pulling the pipe, it contacted the transmission line, causing severe electrical burns to Earl and Roger Lovell. The Lovells sued the Coop for negligence in placing the line near the well. At trial, experts for both sides disputed whether the Coop’s construction complied with the National Electrical Safety Code (NESC). The jury returned a verdict for the Lovells, from which the Coop appealed.
