The plaintiff, Jeannette Ludwig, was insured by Farm Bureau Mutual Insurance Co. under an automobile policy that provided medical payments coverage and contained a subrogation clause. After being injured in an accident with a third-party tortfeasor, Farm Bureau paid $9,380.97 for Ludwig’s medical expenses. Ludwig subsequently sued the tortfeasor and reached a settlement for $45,000. The settlement agreement explicitly allocated $9,380.97 to satisfy Farm Bureau’s subrogation claim for the medical expenses it had paid, with the remainder going to Ludwig and other injured parties. The tortfeasor’s insurer issued a separate check payable jointly to Ludwig and Farm Bureau for the subrogated amount. Ludwig disputed Farm Bureau’s right to the funds, contending she had not been “made whole” by the settlement because it did not fully compensate her for all damages, particularly pain and suffering. The trial court agreed with Ludwig and denied Farm Bureau’s subrogation claim. Farm Bureau appealed.
