Case Facts & Court Holding
Key Facts & Case Background
Juanita Lynch executed a deed conveying land to her daughter, Rebecca Hamrick. Hamrick accompanied Juanita to attorney Julie Wills’s office for the deed preparation and execution. Wills met with Juanita and Hamrick together, though Hamrick testified Wills asked her to leave for part of the consultation. Wills later telephoned Juanita alone to confirm her intentions. Juanita, through her son Buddy as attorney-in-fact, sued to set aside the deed, alleging deception and, later, that the conveyance was for promised lifetime care. Hamrick sought to depose Wills. The Lynches asserted attorney-client privilege. The trial court ruled the events surrounding the deed’s preparation and execution were not privileged. Wills testified at trial, over objection, regarding Juanita’s capacity and voluntariness. On cross-examination, the Lynches had Wills read from her notes of private meetings and a phone call with Juanita, and expressly stated they waived the privilege regarding certain documents and communications. The trial court declined to set aside the deed.
