Plaintiffs, Major League Baseball Properties, Inc. and Los Angeles Dodgers, Inc. (collectively “Los Angeles”), sued defendants for trademark infringement for using “The Brooklyn Dodger” for their restaurants in Brooklyn, New York, starting in 1988. The Los Angeles Dodgers, formerly the Brooklyn Dodgers, relocated from Brooklyn to Los Angeles in 1958, changing their name to “Los Angeles Dodgers.” From 1958 until 1981, Los Angeles made no commercial trademark use of the “Brooklyn Dodgers” mark as the name of its baseball team. In 1981, Los Angeles resumed limited use of the “Brooklyn Dodgers” mark, primarily for historical retrospectives, apparel, and novelty items. Defendants, acting in good faith, conducted trademark searches which revealed no registration for “Brooklyn Dodger” for restaurant services and subsequently opened their restaurants. Los Angeles learned of defendants’ use in July 1988 but did not issue a cease and desist letter until April 1989. Defendants argued abandonment and laches.
