Appellants, lot owners in the Mallard Pointe Subdivision, were subject to a restrictive covenant (Declarations) enforced by Respondent, the Mallard Pointe Lot Owners Association. In March 2021, Appellants received approval from the association’s Architectural Review Committee (ARC) for their fence plans. However, the approval was conditioned on Appellants submitting a signed “builder’s checklist” and a $500 construction deposit prior to starting work. Appellants began installing the fence without satisfying these conditions. On June 10, 2021, the association sent Appellants a notice of violation. Subsequently, it sent a notice for a hearing to be held on June 28, 2021, to address the violation and potential penalties. Section 5.3.2.2 of the Declarations explicitly required “at least twenty (20) days advance written notice” for any hearing held to impose a fine. The hearing proceeded as scheduled, and the association’s Board found Appellants in violation, imposing a $25 per day fine. The association sued for injunctive relief and the accrued fines. The trial court granted summary judgment for the association.
