The City designated Manhattan Community Access Corp. (MNN), a private nonprofit corporation, to operate these public access channels. State regulations mandate that the channels be available to the public on a first-come, first-served, nondiscriminatory basis. Respondents DeeDee Halleck and Jesus Papoleto Melendez, who had produced a film critical of MNN, had their film aired on an MNN channel. After receiving complaints, MNN suspended the producers from all MNN services and facilities. The producers filed suit under 42 U.S.C. § 1983, alleging that MNN, acting under color of state law, violated their First Amendment rights by suspending them based on the content of their speech.
