Case Brief Summary & Legal Analysis

General Brief
4 min read

tl;dr: A woman’s involuntary manslaughter conviction for the death of an infant in her care was reversed because the jury was not instructed that it must first find she had a legal duty to provide care, which is a prerequisite for criminal liability based on a failure to act.

Legal Significance: This case establishes that criminal liability for an omission requires proof of a legal duty, not merely a moral obligation. It provides a key framework for identifying the four circumstances under which such a legal duty to act can arise, solidifying a core principle of actus reus.

Case Facts & Court Holding

Key Facts & Case Background

Appellant Mary Jones took custody of two young children, Robert and Anthony Green, born out of wedlock to her friend, Shirley Green. Anthony was released from the hospital at birth directly into Jones’s care. While there was a financial agreement for the care of the first child, the arrangement for Anthony was disputed. Jones had complete custody of both children. At ten months old, Anthony died of severe malnutrition, weighing only slightly more than he did at birth. A month prior to his death, a doctor had noted the child’s poor condition and recommended hospitalization, but Jones failed to seek further medical care. The children were found in squalid conditions. Jones was convicted of involuntary manslaughter for failing to perform her legal duty of care. At trial, testimony conflicted as to whether Jones had a contractual obligation to care for Anthony and whether the children’s mother was living with Jones, which would affect whether Jones had secluded the child from his natural protector.
