Mary Jackson conveyed real property, including a house, to Ileane Brosnan and Iola Miller, retaining a life estate for herself. Jackson lived in the house and maintained an insurance policy on it. In May 1991, a hailstorm caused substantial damage to the house. Jackson initiated an insurance claim but died on June 1, 1991, before the claim was paid or repairs were made. After her death, the insurance company paid $5,713.50 for the damage. The executrix of Jackson’s estate, who was also a remainderman, initially distributed the proceeds to herself and Brosnan. However, the estate’s final accounting later listed the insurance proceeds as a general asset of the estate, to be distributed among the residuary beneficiaries. The probate court approved this accounting, holding that the right to the proceeds vested in Jackson during her life and therefore belonged to her estate. Brosnan, a remainderman, appealed.
