Case Brief Summary & Legal Analysis
tl;dr: An executor-attorney sold an estate asset to a beneficiary who was also a trustee, favored his own wife in distributions, and took unapproved fees. The court found this constituted prohibited self-dealing and a breach of the fiduciary duty of impartiality, surcharging the executor.
Legal Significance: This case reinforces the strict prohibition against self-dealing by fiduciaries and underscores an executor’s absolute duty of impartiality among beneficiaries. It also affirms the statutory requirement for court approval before an attorney-fiduciary can take advance payment of legal fees from an estate.

Case Facts & Court Holding
Key Facts & Case Background
The decedent’s will, drafted by her son-in-law Bertram Zweibon, named him as executor. The will divided the estate into three equal shares: one-third outright to daughter Gloria (Zweibon’s wife), one-third outright to daughter Louise, and one-third in trust for daughter Beatrice Hornstein. Gloria and Louise were named co-trustees of Beatrice’s trust. As executor, Zweibon sold the decedent’s residence, an estate asset in which the trust held a one-third interest, to Louise Kinzler, a co-trustee. Following the sale, Zweibon distributed approximately $50,000 in cash to his wife, Gloria, representing her share of the proceeds. However, he funded the trust’s one-third share with only the purchase money mortgage from the sale. Zweibon also paid himself legal fees from the estate without obtaining prior court approval as required by statute. Beatrice and her children, the trust beneficiaries, successfully challenged Zweibon’s accounting in Surrogate’s Court, which found he had engaged in self-dealing, breached his duty of impartiality, and improperly paid himself fees. Zweibon appealed the decree.
