After a 48-year marriage, John “Jack” DeVine sued Antoinette “Rita” DeVine for divorce. During the marriage, Rita began an affair with Jack Counts. While concealing the affair, Rita persuaded Jack to invest over $126,000 of community funds into Counts’ various unsuccessful business ventures. Rita also became president of a new corporation, Korrs Investments, which the court found was capitalized by her labor, making its stock community property. Rita received 998 shares of Korrs stock for no cash consideration. Substantial funds, totaling over $1.3 million, flowed through Korrs. Korrs paid for nearly all of Counts’ personal and family living expenses. Rita later transferred her 998 shares of Korrs stock to a non-profit corporation she and Counts controlled, receiving no consideration.
