On June 13, 1985, Catherine H. Vadney executed a deed conveying real property to herself and her son, petitioner Peter J. Vadney. The deed was silent as to the type of tenancy created and contained no survivorship language. New York law, EPTL § 6-2.2(a), establishes a default rule that such a conveyance creates a tenancy in common. Upon Catherine’s death, Peter, as executor, treated the property as a joint tenancy with right of survivorship, passing to him outside of the probate estate. His three siblings objected, arguing the deed created a tenancy in common, which would cause their mother’s one-half interest to pass through her will’s residuary clause to all four children. Peter commenced an action to reform the deed, alleging the omission of survivorship language was a scrivener’s error contrary to his mother’s intent. He presented uncontroverted testimony from the drafting attorney, who stated that the decedent had instructed him to create a joint tenancy and that the omission was his own oversight. The attorney produced notes from his meeting with the decedent that included the phrase “right of survivorship.” A witness to the deed’s execution also testified that the decedent expressed her desire for Peter to have the house.
