Plaintiff Jean Matthies, an 81-year-old woman who lived independently, fell and fractured her hip. Defendant Dr. Mastromonaco, an orthopedic surgeon, determined that surgery to pin the hip was too risky due to her age, frailty, and osteoporosis. Instead, he prescribed a non-invasive “bed-rest treatment.” Dr. Mastromonaco believed Matthies should live in a long-term care facility and that his chosen treatment would facilitate this outcome. He did not fully inform Matthies of the surgical alternative or its potential benefits, nor did he explain the significant risk of the bed-rest treatment—that the fracture could displace, resulting in a permanent inability to walk. Matthies’s fracture did displace, her leg shortened, and she was permanently confined to a nursing home. She sued for medical malpractice and lack of informed consent. The trial court dismissed the informed consent claim, ruling that the doctrine only applies to invasive procedures. The jury found for the defendant on the malpractice claim.
