In a series of 19th-century treaties, the United States guaranteed the Muscogee (Creek) Nation a permanent homeland in what is now eastern Oklahoma. The treaties promised the land would be secure and that the tribe would have the right to self-government, free from state interference. Jimcy McGirt, an enrolled member of the Seminole Nation, was convicted in Oklahoma state court for serious sexual offenses committed within the historical boundaries of this Creek Reservation. McGirt challenged his conviction, arguing that the State of Oklahoma lacked jurisdiction. He contended that because the reservation was never disestablished by Congress, the land remains “Indian country” under the federal Major Crimes Act (MCA), 18 U.S.C. § 1153. The MCA grants the federal government exclusive jurisdiction to prosecute certain major crimes committed by Indians in Indian country. Oklahoma argued that Congress had effectively disestablished the reservation through a series of allotment-era statutes at the turn of the 20th century, which broke up communal tribal lands into individual parcels. The state further argued that over a century of state jurisdiction, demographic shifts, and a shared understanding among all parties confirmed that the reservation no longer existed.
