The U.S. Senate passed a resolution authorizing a select committee to investigate the administration of the Department of Justice under Attorney General Harry M. Daugherty. The investigation concerned allegations of his failure to prosecute violators of federal law and other acts of misfeasance. The committee issued a subpoena to Mally S. Daugherty, the Attorney General’s brother and a bank president, commanding him to appear and testify. After he failed to appear, the committee issued a second subpoena for testimony only, which he also ignored. The full Senate then adopted a resolution declaring M.S. Daugherty’s testimony “material and necessary” as a basis for “legislative and other action” and issued a warrant for his arrest to compel his appearance before the Senate bar. John J. McGrain, a Deputy Sergeant at Arms, arrested Daugherty in Ohio. Daugherty successfully petitioned a federal district court for a writ of habeas corpus, arguing the Senate had exceeded its constitutional authority. The district court ordered his release, and McGrain appealed to the Supreme Court.
