Malia Vandencede presented at Bloomington Hospital with injuries she claimed were from a horse accident, accompanied by her ex-husband, Monty. A triage nurse suspected domestic violence and attempted to discreetly offer help, which Malia rejected. After surgery, Malia’s mother arrived and informed staff that Monty had assaulted Malia, prompting calls to law enforcement and hospital security. Security searched Monty and found no weapons. Despite multiple warnings from a nurse and pleas from her mother not to leave with Monty, Malia, who was deemed “alert and oriented” post-surgery, adamantly insisted on going home with him, telling her mother to “[s]tay out of our business.” Shortly after leaving the hospital, Monty shot and killed Malia before killing himself. Malia’s estate filed a medical malpractice action against the hospital and treating physician for negligence.
