Messiah Baptist Church purchased 80 acres in Jefferson County, Colorado, zoned Agricultural Two District (A-2). Initially, A-2 zoning permitted agricultural uses and dwellings but prohibited churches. In 1974, the Church’s building permit application was denied. In 1976, the County amended A-2 regulations to allow churches via special-use permit. The Church’s 1978 special-use permit application for a worship structure, offices, classrooms, gym, and drive-in amphitheater was denied by the planning commission due to access, erosion, and fire protection concerns. The Church sued, alleging the A-2 regulations (both pre- and post-1976 amendment) were facially unconstitutional under the Due Process and Free Exercise Clauses, and the special-use provisions involved an unconstitutional delegation of power. Thirteen of sixteen residential zones in the County permitted churches by right.
