Dr. Meyhoeffer (lessor) leased farmland to Wallace (lessee) under an agreement stipulating rent as ‘one-fifth (1/5th) of the [annual] crop or $32,000.00, whichever is greater.’ The lease was recorded in parish conveyance records but not in the Louisiana Agricultural Central Registry (LACR). Wallace granted Winnsboro State Bank & Trust Co. (Bank) a security interest in the 1998 crops and proceeds, which the Bank perfected by filing a financing statement in the LACR. When Wallace defaulted, the Bank seized the crop proceeds. Meyhoeffer sued, asserting his lessor’s privilege was superior. The trial court found the Bank’s perfected security interest had priority. On appeal, Meyhoeffer argued he retained ownership of 1/5th of the crops, an argument not raised at trial. The historical practice was for Wallace to sell all crops and pay Meyhoeffer cash rent.
