Case Brief Summary & Legal Analysis
tl;dr: After a domestic partnership ended, one partner sued to reclaim full title to property she had purchased but placed in joint name. The court denied summary judgment, finding a factual dispute over whether a promise to reconvey the property existed, which was essential for imposing a constructive trust.
Legal Significance: This case affirms that the equitable remedy of a constructive trust is applicable to property disputes between unmarried, same-sex domestic partners, treating their relationship as confidential for the purpose of the doctrine, but requiring proof of all elements, including a promise and unjust enrichment.

Case Facts & Court Holding
Key Facts & Case Background
Plaintiff Minieri and defendant Knittel were in a domestic partnership. During their relationship, Minieri used her own funds and credit to purchase a condominium, a house, a vehicle, and to fund several investment accounts. Title to all these assets was placed in the names of both Minieri and Knittel as joint tenants. After the relationship dissolved, Minieri sued to have a constructive trust imposed on the assets, arguing that she never intended to give Knittel a present ownership interest. Minieri claimed the joint titling was solely to provide for Knittel in the event of Minieri’s death and was based on Knittel’s oral promise to reconvey the property upon request. Knittel denied any such promise, asserting the joint titles were gifts and that she had contributed non-monetarily by maintaining the properties. Before the lawsuit, Minieri unilaterally executed and recorded deeds severing the joint tenancies for the two real properties, converting them into tenancies in common. Both parties moved for summary judgment.
