Mountain States Telephone & Telegraph Co. (Plaintiff) held a duly recorded perpetual easement for an underground telephone cable across land later acquired by Behrstock and Burgbacher (Owners). The easement agreement, including a detailed blueprint, was on record. The Owners, possessing actual knowledge of the easement from a title report and constructive knowledge from the record, hired John C. Kelton and Son (Contractor) to clear and level the land for development. The Contractor, who had no actual knowledge of the cable’s existence or location and was not informed by the Owners, used a bulldozer for excavation. While trenching to mix ashes with dirt after burning cleared trees, the bulldozer struck and damaged Plaintiff’s underground cable. The trial court found the cable was buried approximately 2.5 feet deep and that the Contractor could not have determined its presence with reasonable care. Plaintiff sued both the Owners and the Contractor for damages, alleging negligence and later attempting to amend to include trespass.
