Eva Barnes, an elderly and increasingly vulnerable woman, executed a new will shortly before her death at age 94. This will was a “radical departure” from her prior estate plans, completely disinheriting her nieces and nephew (the Rovas), who were her closest living relatives and prior beneficiaries. The new will named Michelle Wells, Barnes’ mail carrier turned caretaker, and Wells’ husband as the sole beneficiaries. As Barnes’ physical and cognitive health declined, her dependence on Wells grew. During this time, Wells became Barnes’ attorney-in-fact and actively isolated her from the Rovas by making numerous false statements to poison their relationship. For example, Wells falsely accused the Rovas of wanting to put Barnes in a nursing home and of being “greedy villains.” Wells drove Barnes to the attorney’s office for the meetings that resulted in the new will. The Rovas challenged the will, alleging undue influence. The trial court found that while Barnes had testamentary capacity, the will was the product of undue influence. Wells did not challenge the trial court’s 83 findings of fact on appeal.
