Case Brief Summary & Legal Analysis
tl;dr: A father sought to modify child custody based on domestic violence in the mother’s home. The state supreme court reversed the trial court’s denial, holding it applied an erroneously high standard for what constitutes domestic violence at the initial “change of circumstances” stage of the analysis.
Legal Significance: This case clarifies that a single incident of domestic violence, even if not a pattern or causing serious injury, can constitute a material change of circumstances sufficient to trigger a full best-interest analysis for custody modification.

Case Facts & Court Holding
Key Facts & Case Background
Following their divorce, Heidi Wolf (mother) was granted custody of the parties’ two children. Years later, the daughter moved in with Lyle Niemann (father) by agreement. The father then filed a motion to modify custody of the son, alleging a material change in circumstances. The allegations centered on the mother’s home environment, including alcohol abuse and domestic violence perpetrated by the mother’s new husband. One specific incident in May 2005 involved the stepfather yelling, swearing, and allegedly pushing the mother in front of the children. The children were frightened by the event, with the daughter testifying she snuck out of the house in fear. A court-appointed custody investigator interviewed the parties and recommended a change of custody to the father, citing concerns about domestic violence. The district court, however, found there was no “credible domestic violence or a pattern of domestic violence” and concluded that no material change of circumstances had occurred. It therefore denied the father’s motion without proceeding to a full best-interest-of-the-child analysis.
