During the marriage, the husband, an insurance agent and manager, entered into contracts entitling him to renewal commissions on policies sold by him and his agents. These commissions were contractually vested, surviving even death or disability, but were contingent on certain conditions like non-competition and maintaining a required renewal volume. The right to commissions was also assignable with company consent. At the divorce trial, both parties’ experts provided a present value for these future commissions based on industry persistency rates, with the husband’s expert calculating a value of $410,000. During the marriage, the husband also took $267,000 in “advances” from the insurance company. These advances were loans, repayable on demand, and could be set off against future commission payments. The trial court classified the full $410,000 value of the commissions as marital property. However, it treated the $267,000 debt as a nonmarital “economic circumstance” of the husband under § 8-205(a)(3), rather than as a direct reduction in the asset’s value, before making a monetary award to the wife.
