Pursuant to its authority under the National Labor Relations Act, the National Labor Relations Board (NLRB) ordered a representation election for employees at Wyman-Gordon Co. In connection with the election, the NLRB ordered the company to provide a list of employee names and addresses to the participating unions. This order was based on a rule the NLRB had announced in a prior adjudication, Excelsior Underwear Inc., 156 N.L.R.B. 1236 (1966). In Excelsior, the Board established a general requirement for employers to furnish such lists but stated the rule would apply only prospectively to elections held 30 days after that decision. The NLRB did not follow the notice-and-comment rulemaking procedures of the Administrative Procedure Act (APA) when it created the Excelsior rule. Wyman-Gordon refused to provide the list, arguing that the Excelsior rule was an invalidly promulgated legislative rule. The NLRB issued a subpoena to compel production of the list, and when the company refused, the Board sought enforcement in federal court.
