Appellants, David and Lisa Norris, hired Leonard Besel’s sole proprietorship, Leonard’s Home Improvement, for a home remodel. The initial contact occurred after Leonard’s wife, Shelly Besel, responded to a Facebook inquiry by promoting “My husband[‘s]” business. The subsequent written contract for the project was executed solely between the Norrises and Leonard Besel, who was identified as the owner. During the project, Shelly Besel performed various administrative tasks, including managing the business’s Facebook page, relaying messages from the Norrises to her husband, and occasionally typing bids and invoices. The Besels filed joint tax returns, but the business was consistently listed on a Schedule C form as a sole proprietorship owned by Leonard Besel. He maintained separate bank accounts for the business, and there was no evidence of an agreement to divide profits with his wife.
