The testator, B. F. Montague, devised property through his will, creating a series of successive future interests. The devise granted a life estate to his wife, followed by a life estate to his three daughters as a class with rights of survivorship. Upon the death of the last surviving daughter, a life estate was granted to his grandchildren as a class. The ultimate remainder interest was devised to the “lawful issue of such grandchild or grandchildren” (the testator’s great-grandchildren) upon the death of the last surviving grandchild. At the time of the testator’s death, his three daughters were living. The validity of the final remainder interest to the great-grandchildren was challenged on the grounds that it violated the common law Rule Against Perpetuities (RAP). The appellant conceded that the gift was potentially void under a strict application of the RAP but argued that the court should apply the Doctrine of Separability to save the portions of the gift that would validly vest in the issue of grandchildren who were alive at the testator’s death.
