Plaintiffs Virgilio and Teodora Orcilla, who had limited English proficiency and income, refinanced their home in 2006. The loan terms, particularly the monthly payments of $4,220.49, significantly exceeded Teodora’s monthly income of less than $3,000 (Virgilio was unemployed). In 2008, they entered into a loan modification agreement, but the modified payments of $4,627.47 still exceeded their income. The Orcillas alleged both the original loan and the modification were unconscionable. After defaulting, Bank of America (BofA) allegedly promised to postpone the trustee’s sale pending review of their HAMP application. However, the sale proceeded, and defendant Big Sur, Inc. purchased the property. The Orcillas sued to set aside the sale, alleging wrongful foreclosure based on, inter alia, the unconscionability of the loan agreements and violations of foreclosure statutes. The trial court sustained demurrers to all claims. The Orcillas appealed.
