Jose and Socorro Quintana married in 1958. In 1971, Jose began an affair with Esther Osuna, later participating in a ceremonial marriage with her in 1983 while still married to Socorro. Jose, who had sole control over his businesses and their income, purchased a house for Osuna using $164,465.32 from a community property business account as a down payment and paid the mortgage for seven years. He also purchased two Mercedes Benz vehicles and a Dodge minivan for Osuna with community funds. Shortly before Socorro filed for divorce, Jose allegedly transferred substantial sums, totaling $460,000, to Osuna, deposited into her bank accounts. Socorro had no knowledge of these transactions or Jose’s business management. The trial court awarded Socorro a $460,000 joint and several judgment against Jose and Osuna for fraud on the community, plus the vehicles and foreclosure proceeds from the house purchased for Osuna. Osuna appealed, challenging the money judgment and the award of property she claimed as hers.
