In 1944, the Pachecos (Defendants) acquired two adjacent lots, 4 and 5. Their home was built on Lot 5. In 1950, they were required by the city to connect to a new sewer main located along the street adjacent to Lot 4. They installed a sewer line from their home across Lot 4 to connect to this main, as it was the only available connection point. In 1953, the Pachecos sold Lot 4 to a predecessor of the Oteros (Plaintiffs). The deed conveying Lot 4 did not contain an express reservation of an easement for the sewer line. The property passed through several owners before the Oteros purchased it in 1965. The Oteros were unaware that the sewer line serving the Pachecos’ home crossed their property until 1974. After discovering the shared line, the Oteros sued, and the Pachecos counterclaimed, asserting they possessed an easement.
