The parties married in 1975 and had two children. The husband was a wealthy real estate developer, and the wife was a homemaker. In 1985, after ten years of marriage, the husband threatened to divorce his wife unless she signed an agreement limiting her economic rights in the event of a future divorce. To coerce her, he moved out of the marital bedroom. The wife, who did not want a divorce and wished to keep the family intact, retained an attorney who advised her not to sign. Despite this advice, she signed the agreement, stating she would do anything to preserve the marriage. The agreement provided her with a lump sum of $500,000 and waived all her rights to alimony and any further equitable distribution. At the time, the marital estate was approximately $3 million, making the payout roughly 18% of the assets acquired during the marriage. The husband filed for divorce in 1994, by which time the marital assets had grown to over $8 million. The trial court found the agreement enforceable, but the wife appealed.
