Jane Wylie, acting as agent for her husband Charles Wylie, sought to finance a car purchase and obtain credit life insurance through C.C. Collier, a car dealer. Collier used forms provided by Pacific Finance Corporation (Pacific) to process applications for financing and insurance. Pacific had a master policy with Old Republic Credit Life Insurance Company (Republic), authorizing Pacific to issue insurance certificates to its debtors. Jane Wylie informed Collier that the insurance should be on the life of her husband, Charles, who would be making the payments, and Collier agreed. However, due to what the jury found was a mutual mistake between Jane Wylie and Collier, the resulting insurance certificate was issued on the life of Jane’s father, D.A. Long. After Charles Wylie died, the mistake was discovered. Pacific and Republic denied the claim, arguing Collier was not their agent or had acted outside the scope of any agency relationship. The trial court entered judgment for the plaintiffs based on jury findings that Collier was a special agent for Pacific, he acted within the scope of that agency, and the policy was issued on the wrong person due to mutual mistake.
