Case Facts & Court Holding

Key Facts & Case Background

Jean McDougall (Plaintiff) and Robert C. Page (Defendant) divorced in 1951. A property settlement agreement, incorporated into the decree, obligated Defendant to pay $6,325 yearly alimony and maintain $30,000 life insurance for Plaintiff. At the time of divorce, Defendant, a physician, earned $37,233.39. His employment with Standard Oil terminated in June 1954. Subsequently, Defendant experienced serious health issues, including a partial gastrectomy, which restricted his activities and ability to find gainful employment. His income significantly decreased; his estimated income for 1960 was $8,740.55, derived primarily from dividends and interest. Defendant’s net worth was stated to be somewhat in excess of $100,000, and he had remarried and maintained a comfortable lifestyle. In 1959, Defendant petitioned to modify the alimony due to his ill health, unemployment, and reduced income. The trial court reduced alimony to $350 per month. Both parties appealed the modification order.
