Case Brief Summary & Legal Analysis

General Brief
4 min read

tl;dr: A federal district court upheld a Seattle school district’s use of a racial tiebreaker in its high school assignment plan, finding that the district’s interest in remedying de facto segregation and promoting diversity was compelling and that the plan was narrowly tailored to achieve those goals.

Legal Significance: This opinion established that remedying de facto segregation is a compelling government interest under the Equal Protection Clause, distinct from remedying past de jure discrimination, and that race-conscious student assignment plans designed for this purpose can survive strict scrutiny.

Case Facts & Court Holding

Key Facts & Case Background

Due to historical residential segregation, Seattle’s neighborhoods and, consequently, its schools were racially imbalanced. To counteract this, the Seattle School District implemented an “open choice” high school assignment plan. Students ranked their preferred schools. For the five most popular, oversubscribed high schools, the district used a series of tiebreakers. After a sibling preference, the district employed a racial tiebreaker if a school’s racial demographics deviated by more than 15% from the district-wide average of approximately 40% white and 60% nonwhite students. The tiebreaker gave an admissions preference to students whose race would help bring the school’s population closer to the district average. For example, a white student would receive a preference at a predominantly nonwhite school, and a nonwhite student would receive a preference at a predominantly white school. Parents Involved in Community Schools, a group of parents whose children were denied their first-choice school because of this tiebreaker, sued the district, alleging the policy violated the Equal Protection Clause of the Fourteenth Amendment and state law.
