The insured, Rosato, caused a car accident that rendered the plaintiff, Pavia, a hemiplegic. The insurance policy with State Farm had a $100,000 limit. While State Farm’s initial investigation suggested its insured was 100% liable for severe damages, the insured’s subsequent deposition raised potential new defenses, including an emergency situation and the plaintiff’s failure to wear a seatbelt. Seventeen days after this deposition, plaintiff’s counsel sent State Farm a letter demanding the full $100,000 policy limit, giving them 30 days to accept. State Farm did not respond before the deadline, as it was actively investigating the new defenses. After the investigation proved fruitless several months later, State Farm offered the full policy limit. The plaintiff rejected the offer as untimely. The underlying personal injury trial resulted in a multi-million dollar judgment against the insured, far in excess of the policy limit.
