A minor, Kevin Peace, allegedly sustained lead poisoning by ingesting lead from paint chips, flakes, and dust in an apartment owned by the insured, Djukic Enterprises. Prior to purchasing the insurance policy, Djukic had received a notice of ordinance violation from the City of Milwaukee identifying a hazardous concentration of lead in loose, peeling, flaking, or chipped paint on the premises. Djukic later obtained a commercial general liability (CGL) policy from Northwestern National Insurance Company. The policy contained an absolute pollution exclusion clause, which barred coverage for bodily injury “arising out of the actual, alleged or threatened discharge, dispersal, release or escape of pollutants” at or from premises owned by the insured. The policy defined “pollutants” as “any solid, liquid, gaseous or thermal irritant or contaminant, including…chemicals and waste.” When Peace sued Djukic for negligence, Djukic tendered the defense to Northwestern. Northwestern denied coverage and its duty to defend, relying on the pollution exclusion clause, and moved for summary judgment.
