A minor, Kevin Peace, allegedly sustained lead poisoning from ingesting lead-based paint chips, flakes, and dust while residing in an apartment owned by Djukic Enterprises. Six weeks before purchasing an insurance policy from Northwestern National Insurance Co., Djukic had received a notice of violation from the city health department identifying a hazardous concentration of lead in loose and peeling paint on the premises. Djukic subsequently purchased a commercial general liability (CGL) policy from Northwestern. The policy contained an absolute pollution exclusion clause, which barred coverage for bodily injury arising from the “discharge, dispersal, release or escape of pollutants.” The policy defined “pollutants” as “any solid, liquid, gaseous or thermal irritant or contaminant, including…chemicals and waste.” After Peace sued Djukic for negligence, Djukic tendered its defense to Northwestern. Northwestern denied coverage, asserting that the claim fell squarely within the pollution exclusion, and sought summary judgment declaring it had no duty to defend.
