Plaintiff Penguin Group, a publisher with its principal place of business in New York, sued defendant American Buddha, an Oregon non-profit operating from Arizona, for copyright infringement in the Southern District of New York. Penguin alleged that American Buddha uploaded complete copies of four books to which Penguin held the copyright onto its websites, making them freely available to the public. The electronic copying and uploading occurred in Oregon or Arizona. American Buddha moved to dismiss for lack of personal jurisdiction.
