In 1938, an easement for ingress and egress was created, burdening a servient tenement owned by Hot Shoppes, Inc. (appellee) and benefiting an adjacent dominant tenement. Penn Bowling Recreation Center, Inc. (appellant) later acquired a portion of the dominant tenement and also purchased adjacent, non-dominant land. Appellant constructed a single building, housing a bowling alley and restaurant, which spanned both its portion of the dominant tenement and the non-dominant land. Appellant used the easement to service the entire building, including delivering supplies to and removing trash from portions of the building situated on the non-dominant land. Appellee obstructed the right of way and filed suit, claiming appellant had forfeited the easement through misuse by extending its benefit to the non-dominant parcel, by parking vehicles on the easement, and by constructing a loading platform that allegedly made ingress/egress impossible. The district court granted summary judgment for appellee, declaring the easement forfeited and extinguished. Penn Bowling appealed.
