The defendant, Don Ceballos, lived alone. After a prior theft and discovering pry marks on his garage door, he mounted a loaded .22 caliber pistol inside the garage, which was part of his dwelling. The pistol was aimed at the center of the garage doors and rigged with a wire to fire if the doors were opened. Two unarmed teenagers, Stephen (16) and Robert (15), returned to Ceballos’s home while he was away, intending to steal musical equipment. Stephen used a crowbar to pry open the garage door. As the door opened, the trap gun discharged, striking Stephen in the face and causing injury. Ceballos admitted to setting the trap gun to protect his property and prevent a potential confrontation with a thief. He was subsequently charged and convicted of assault with a deadly weapon.
