The defendant, Petros Demetrios Latsis, was charged with two counts of criminal solicitation to commit aggravated robbery under Colorado’s criminal solicitation statute, § 18-2-301, C.R.S. 1973. The statute defines the offense as when a person attempts to persuade another to commit a felony “with intent to promote or facilitate the commission of that crime, and under circumstances strongly corroborative of that intent.” The statute also contains an exception for “bona fide acts of persons authorized by law to investigate” crimes. Latsis moved to dismiss the charges, arguing the statute was unconstitutionally vague and overbroad. The district court agreed, finding the phrases “bona fide” and “under circumstances strongly corroborative of that intent” to be impermissibly vague. The trial court also held that the “strongly corroborative” language constituted an unconstitutional delegation of the legislature’s power to define a crime to the judiciary. The district attorney appealed the dismissal directly to the Supreme Court of Colorado.
