During pretrial discovery, Turner’s counsel learned that M.P. had received assistance from the Alliance Against Domestic Abuse (the “Alliance”), a non-profit victim advocacy center. Turner served a subpoena duces tecum on the Alliance, demanding production of all records concerning the assistance provided to M.P. The Alliance moved to quash the subpoena, asserting the victim-advocate privilege under section 13-90-107, C.R.S. Turner moved to compel, arguing the privilege only protected communications from the victim to the advocate, not records of assistance provided by the advocate. The trial court agreed with Turner and ordered the Alliance to produce a “broad outline” of the assistance it provided to M.P., reasoning such records were not privileged communications.
